LandmarX Terms of Use

Effective Date: August 1, 2025

These Terms of Use ("Terms") govern your use of the LandmarX mobile application and services (collectively, the "Services") provided by LandmarX, Inc. ("LandmarX," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian's permission.

2. Use of Services

​

LandmarX provides users with customizable travel itineraries and recommendations based on user preferences. You agree to use the Services only for personal, non-commercial purposes and in compliance with all applicable laws.

3. Account Registration

​

To access certain features, you must create an account. You agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your account and password and accept responsibility for all activities that occur under your account.

4. Subscription and Payment

​

LandmarX offers various usage tiers:

• Guest: Non-paid access to view sample itineraries and try itinerary building features

• The Jetsetter: Travel planning credits for 7-days. Days do not expire.

• The Globetrotter: Unlimited itinerary planning for 12 months.

Information on specific features are detailed in the pricing page on the app.

All purchases are final and non-refundable except as described in our Re-Credit Policy below. Subscription terms will renew automatically unless canceled at least 24 hours before the end of the current billing period.

5. Re-Credit Policy

If a user cancels a planned trip before its scheduled start date, they may be eligible to receive unused itinerary day credits back to their account, subject to the following terms:

• A request for re-credit must be made within 30 days of the original trip’s scheduled start date.

• Re-credited days must be used within 12 months of issuance.

• Two re-credit requests are allowed per year for Jetsetter users.

• Globetrotters are entitled to unlimited re-credits during their subscription period.

• Credits will not be issued for days that were already used or part of a trip in progress.

• Re-credits are not monetary refunds and have no cash value.

6. User Content

At LandmarX, we respect your privacy and believe you should have control over your personal data. If you would like to delete your account and remove your personal data from our systems, you can request data deletion by emailing us at hi@landmarx.ai with the subject line: "Data Deletion Request".

Please include:

• The email or phone number associated with your LandmarX account

• A brief note confirming your request

We will process your request within 7 business days after verification of the user request.

What happens when you request data deletion:

• Your account will be permanently deactivated

• All personal information will be removed from our systems

• Your trip data, preferences, and saved places will be deleted

• You will no longer receive any communications from us

• This action cannot be undone

Please note: Some data may be retained for legal or regulatory compliance purposes, but this will be limited to what is absolutely necessary and will not include personally identifiable information.

7. User Content

You retain ownership of any content you post or share via the Services (e.g., photos, reviews). By uploading content, you grant LandmarX a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display the content in connection with the Services.

You agree not to post content that is unlawful, offensive, misleading, or infringes on the rights of others.

8. Intellectual Property

All intellectual property rights in the Services and content provided by LandmarX (excluding User Content) are owned by LandmarX or its licensors. You may not copy, distribute, or create derivative works from the Services without our express written permission.

9. Prohibited Conduct

​

You agree not to:

• Use the Services for any unlawful purpose;

• Interfere with or disrupt the Services;

• Attempt to gain unauthorized access to user accounts or systems;

• Use automated tools to access the Services without permission.

10. Third-Party Services

​

The Services may contain links or integrate with third-party services (e.g., mapping, bookings). LandmarX is not responsible for the content, policies, or practices of those third parties.

11. Disclaimer of Warranties

​

The Services are provided "as is" and "as available." We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. LandmarX does not guarantee the accuracy, availability, or reliability of travel recommendations or itineraries.

12. Limitation of Liability

​

To the maximum extent permitted by law, LandmarX shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, arising from your use of the Services.

13. Indemnity

​

You agree to indemnify and hold harmless LandmarX, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses arising from your use of the Services or violation of these Terms.

14. Modifications

​

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms in the app or via email. Continued use of the Services after changes indicates your acceptance.

15. Termination

​

We may suspend or terminate your access to the Services at our discretion, with or without notice, for any reason, including violation of these Terms.

16. Governing Law

​

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
